This site is owned and operated by Homestyle Group Plc trading as Sleepmasters (referred to as ‘Sleepmasters’, ‘we’ or ‘us’ ‘our’).
By using or accessing this website and/or placing any order(s), you agree to be legally bound by these terms and conditions. All other terms and conditions, including those that may be proposed in any order submitted by you, are expressly excluded and shall have no effect.
Receipt by Sleepmasters of an order via our website does not constitute legal acceptance of an order. Your order will be deemed to have been accepted by us only once you have received written confirmation of our acceptance. We reserve the right to refuse your order for any reason we see fit.
These terms relate to sales over the Internet only. Separate terms and conditions apply to purchases made directly from our stores.
DEFINITIONS
"Buyer" means the Consumer who buys or agrees to buy Goods on this website from Sleepmasters.
"Goods" means all products listed on the order and the order confirmation e-mail
"Consumer" has the meaning given in section 12 Unfair Contract Terms Act
1977
"Special Items" or “specials” mean any Goods that are not held in stock by Sleepmasters and are ordered and/or manufactured specifically for the Buyer.
"Delivery" means the delivery of the Goods to the delivery address specified on the order.
RISK AND OWNERSHIP
The Goods shall be at the Buyer’s risk once delivery has taken place. The Buyer must take all reasonable care of the Goods. Should the Goods be returned to Sleepmasters having been damaged while in the Buyer1s care, the cost of such damage will be recovered from the Buyer.
Ownership of the Goods will only pass when cleared funds have been received from the Buyer, regardless of whether delivery has taken place.
LIMITATIONS OF LIABILITY
Our total liability in regard to the performance of this contract shall be limited to the value of the Goods. Sleepmasters shall not be liable for any direct, indirect or consequential losses, costs or expenses incurred or any consequential compensation arising out of the performance/or non performance of this contract.
Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not otherwise be limited or excluded under applicable law. All contracts shall be governed by English Law. Sleepmasters retain the right to refuse any order that is subject to an error on its website and will in these circumstances reimburse the Buyer in full.
VAT
All of our quoted prices are inclusive of VAT at the prevailing rate, however adjustments will have to be made to comply with any change in rates or other legally imposed changes in respect of VAT.
PAYMENT
Full payment will be required at time of order. All Prices and charges on this site are in U.K. pounds and include any V.A.T payable at the prevailing rate.
INTEREST FREE CREDIT
Sleepmasters is a licensed credit broker.
All offers are subject to availability. Unless otherwise stated prices exclude headboards, mattresses, pillows and accessories. Interest free credit is available on orders of £299.95 and over paid over 10 months.
DELIVERY
There is a nominal charge of £35.00 for delivery within the UK Mainland and Northern Ireland. Target delivery dates will be arranged within our normal delivery areas on designated days, which we will notify to you. Sometimes we may not be able to deliver to you on the target delivery date because of circumstances beyond our control (e.g. due to extreme weather, traffic accidents, and so on), in which case we will let you know as soon as we can and will re-arrange the target delivery dates with you. You must inspect all goods on delivery and advise us of any shortfalls or visible damage. Should this be impractical because of packaging, etc. notification of any such damage or shortfall is to be given to us within 3 days.
Delivery will normally take place within the timescales estimated on the order acknowledgement (and in any case within 60 days), however this is only an estimate and time shall not be the essence of any order. As a guide most items will be delivered within 28 days of the order confirmation if not even quicker. On certain occasions delivery may be over 28 days, due to external factors beyond our control, however we make every effort to ensure this will not happen.
Certain smaller Goods may be delivered by post or courier.
At Sleepmasters you will receive a call from our delivery team (between 12.00pm and 5.00pm) two days before your delivery is due, to notify you of the estimated time of the arrival i.e. before 1pm or after 12pm.
Sleepmasters deliver from Monday to Friday and do not deliver on Bank Holidays.
Delivery is limited to Mainland UK and Northern Ireland.
Delivery will only be made to the delivery address specified on the original order.
Delivery will be deemed to have taken place when the Goods have been delivered to the agreed address and signed for by persons 18 years+.
For website sales the customer must sign for goods and provide ID at the point of delivery. If goods are being accepted by third party we must have their details and ID must be provided on delivery.
ACCESS
Delivery is officially to the Customers’ front door. It is the Customers’ responsibility to ensure that access is clear. Should the goods not fit into their chosen location or should we be unable to deliver goods to you due to inadequate access we shall be entitled to cancel your order and will refund your payments less a 10% administration fee to cover our costs of dispatch and attempted delivery.
Most Goods will require some form of assembly and it is the Buyer’s responsibility to assemble the Goods.
COLOURS AND FINISHES
Photographs and colour swatches displayed on our website are representative of the finished product. Whilst every effort will be made to match all colours and finishes, goods are supplied on the understanding that there may be slight dye, shade, grain and texture variations, particularly with natural products such as wood and leather.
The description of the goods will be as specified within the confirmation e-mail and it is the Buyer’s responsibility to check that the Goods specified are as the Buyer intended to order.
There may be certain items included in the illustration of a product which are not part of the product and are not included in the product description and are not part of the order, (for example, bedside tables, lamps, pillows and quilt sets).
GUARANTEES
The unique Sleepmasters 28 Day Comfort Guarantee is only available on certain Goods purchased direct from one of our 120 plus nationwide Sleepmasters branches. It does not apply to any Goods purchased online.
FAULTY GOODS
Sleepmasters guarantee to repair or replace any part of a bed deemed to be defective due to faulty materials or workmanship free of charge for a period of 5 years.
The guarantee is subject to proof of date of purchase by means of a copy of the Sleepmasters invoice.
Mattresses are subject to the same 5 year guarantee providing that they are purchased and used in conjunction with a Sleepmasters bedstead. Mattresses bought separately, the starter mattress provided free with bedsteads, headboards, furniture, soft furnishings, linens and clearance items are covered by the guarantee (usually 1 year) provided by the relevant manufacturer.
The guarantee will not apply if the product has
- Been subject to excessive wear and tear
- Suffered accidental damage
- Been allowed to become soiled
Note: to avoid unnecessary disputes it is recommended that all new beds are covered with a Sleepmasters Mattress Protector.
During the first 12 months all reasonable efforts will be made to match fabrics. However, after this time, where a divan base, mattress or drawer is repaired or replaced a match cannot be guaranteed.
Statutory rights remain unaffected by the terms of this guarantee.
Please Note: goods should be examined carefully on delivery and any damage reported within 3 days.
CANCELLATIONS AND REFUNDS
This order constitutes a legally binding contract. Cancellations will not normally be allowed except in accordance with your rights under sales of goods legislation or where the company is in breach of our legal obligations.
Placing an order with us ‘On-Line’ constitutes a legally binding contract.
You do however have the statutory right to cancel your order. Should you decide to do so you must notify us in writing (including email) . If you choose to cancel your order we reserve the right to charge upto 20 per cent of your total order value to cover administration costs. This will be done on a discretionary basis if the cancellation is received within 7 working days of receipt of the goods, however after this 7 day period a charge will be made to cover administrative costs.
Following cancellation and pending collection, you must not use the goods, must keep the goods with you, take care of them, and must make them available to us when we call to collect them on the date we will agree with you. We will collect the goods and then refund your money within 30 days of cancellation. Please ensure that the goods are maintained in a saleable condition: if at all possible (for self assembly furniture) unassembled, and in their original packaging.
If you do not comply with your obligations above, we may make a reasonable charge to cover any costs that we incur (for example in respect of wasted collection journeys or goods that you have damaged or lost).
THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.
